Morgantown City Council was under the impression that they had 4 months to appeal Judge Tuckers ruling. Some of you may have seen this letter from the League of Women Voters of Morgantown-Monongalia County to the Morgantown City Council. Now according to State Journal reporter Pam Kasey, the City ignored “a change to the West Virginia Rules of Civil Procedure on Dec. 1, 2010, requiring that a Notice of Appeal be filed within 30 days of entry of the judgment being appealed,” said Jackson Kelly lawyer Laurie Miller in an email response to a query from The State Journal.
The ban is effectively dead. Fracking begins today at the Morgantown Industrial Park.
